The informative self-determination as a barrier for information freedom and for professional practice of journalism
Abstract
The Spanish legislation very strictly regulates the possibility of obtaining, treating and using personal data (especially when using computer science technology), and limits, prohibits and sanctions the regular and necessary professional practices of journalism and prevents working with efficiency, responsibility and quality. This article analyzes the confrontation between the right to informative self-determination and information freedom. It also shows the serious legal insecurity in which journalism must be exerted under the present legislation of protection of personal data.Keywords
